About the role

Key responsibilities & impact
  • Report directly to the Managing Partner of Litigation South
  • Manage contested and uncontested matters for residential and commercial mortgage lenders and investors
  • Handle title review and title curative responsibilities
  • Handle judicial and nonjudicial foreclosure tasks throughout Texas
  • Appear in court and argue motions for foreclosure, eviction, title disputes, HOA/COA disputes, and other matters
  • Communicate regularly with clients regarding updates and case resolution
  • Analyze loan files, title reports, and client documents
  • Draft motions and prepare written discovery and responses
  • Review title examinations within 24–48 hours, identify title issues, and recommend cures
  • Execute cures for simple and complex title issues
  • Review pleadings, loan documents, and foreclosure documents to provide legal opinions and rectify file-level issues
  • Review judicial and nonjudicial foreclosure documents for accuracy and compliance
  • Communicate with insurers and other outside parties
  • Create, review, and edit reports, opinions, correspondence, and foreclosure/title-clearance documents
  • Monitor and advance an independent caseload
  • Apply independent judgment to file-level legal and compliance issues
  • Maintain relationships with insurers, vendors, and team members
  • Update internal and external case management systems and client systems accurately and timely
  • Perform other duties as needed

Requirements

What you’ll need
  • Licensed and in good standing in the State of Texas
  • Minimum two (2) years as a practicing attorney
  • J.D. degree
  • Minimum 2 years of related real estate and title review/curative experience
  • Knowledge of Federal, State, and Local laws
  • Knowledge of Texas Title Standards preferred
  • Knowledge of Texas Mortgage Foreclosure Law preferred
  • Experience in Texas default servicing and foreclosure litigation a plus
  • Strong writing skills
  • Strong written, oral communication, and interpersonal skills
  • High-level proficiency in MS Office suite
  • Proficiency in internet research activities
  • Familiarity with case and document management software
  • Proficiency in client systems strongly preferred (BKFS, Tempo, etc.)
  • Ability to navigate jurisdictional requirements and title standards
  • Ability to manage a portfolio of files and an independent caseload
  • Ability to work independently or in a group/team setting
  • Ability to manage time and priorities, multitask, and adapt to change
  • Exceptional organizational skills and high levels of accuracy and thoroughness
  • Ability to maintain professionalism and courtesy in adversarial situations
  • Must be legally authorized to work in the United States now and in the future
  • No employment sponsorship or immigration support available, including CPT, OPT, STEM OPT, TN, E-3, H-1B, and O-1 sponsorship
